Baseline Festival Terms and Conditions 📄

The Terms and Conditions govern all entry to Baseline Festival and all content, services, and products available through the festival, including, but not limited to, entertainment, licensed areas, food vendors and markets.

‍By purchasing a Ticket and attending Baseline Festival you are agreeing to the following Terms and Conditions.

DEFINITIONS

“Ticket Holders” or “Attendee(s)” refers to any person having purchased or received a Ticket(s) or admittance. Attendees and Ticket Holders include, without limitation, artists, performers, guests, complimentary attendees, contractors on site, volunteers, vendors, suppliers, and sub-contractors in any capacity.

“Baseline 2024” refers to the Event organised by Limitless Touring Limited hosted at Logan Park in March 2024.

“Terms and Conditions” refers to this document which can also be referred to as “Terms” and “Terms of Entry”. The Terms and Conditions outline the terms of attendance to Baseline Festival. 

“Baseline Festival” refers to the Event which the Terms and Conditions apply to and may also be referred to as the “Event”, “Event Organisers” and “Festival”.

“Wristband” refers to the wristband that is provided to all Attendees upon entry to the Event.

“Accreditation” refers to any form of Wristband or Lanyard that is provided by the Event for the purpose of identification. Accreditation is invalid without a valid Ticket or listing in the Accreditation database.

1. GENERAL

  • The Terms and Conditions may be amended from time to time. Any changes will take effect when they are published on the Baseline Festival Website.

  • The Terms and Conditions for the purchase of Tickets will be available through designated sales agent(s). If the designated sale agent’s Terms and Conditions conflict or contradict Baseline Festival’s Terms and Conditions, these Terms and Conditions will prevail and apply.

  • All Attendees on site must have appropriate identification for the Event such as a valid Ticket, Wristband or Accreditation.

  • The artist line-up and all announced attractions are subject to change at any time without notice. However, the Event Organisers will endeavour to announce any significant changes through social media and on the Baseline Festival Website.

  • Baseline Festival Tickets cannot be used as part of any marketing, media, or sales promotion whether commercial or non-commercial without prior written permission of the Event organisers.

  • In accordance with Smoke-Free Regulations, Attendees must comply with signage prohibiting smoking (including e-cigarettes) in designated areas such as, for example, indoor stages. Attendees must comply with signage such as “Smoke Free” or “No Smoking” indicating that smoking is prohibited in certain areas. Failure to comply with the signage, and the regulation, may result in removal from the site.

  • Due to the nature of the Event, Attendees may be exposed to loud and excessive noise. Exposure to noise may result in noise-induced hearing loss. Attendees are responsible for acquiring and using ear protection devices such as ear plugs, and taking other protective measures as required. The Event accepts no liability for any hearing loss suffered at the event.

  • Pyrotechnics, lasers, smoke machines, strobe lighting and special effects may take place during some performances. The Event will endeavour to make appropriate signage available in relevant areas and stages to ensure that Attendees with conditions such as photosensitive epilepsy are aware of the use of strobe lighting and special effects.

  • All Attendees on site must comply with all official directives in the event of emergency situations or evacuation. Attendees must comply with instructions from Festival Staff and Emergency Services. Failure to do so may result in denial of entry, immediate removal, or referral to New Zealand Police.

2. ENTRY, TICKETS AND REFUNDS

  • Upon purchasing or receiving Ticket(s) you are agreeing to Baseline Festival’s Terms and Conditions, the Terms and Conditions of the Ticket and the Terms of Sale of the designated sale agent. The designated sale agent’s Term of Sale can be found HERE.

  • If any of the applicable Terms of Sale / Terms and Conditions contradict or conflict, Baseline Festival’s Terms and Conditions will prevail and apply.

  • There will be no admittance into the Event without a valid Ticket or Accreditation.

  • Baseline Festival reserves the right to make all Tickets non-transferable.

  • All Tickets are non-refundable unless the Event is cancelled.

  • The following terms apply if the Event is cancelled due to non-COVID-19 related reasons.

    • All ticket holders will receive a 100% refund or the option to retain tickets for a postponement date.

  • The following terms apply if the Event is cancelled due to COVID-19 related reasons.

    • All ticket holders will receive a 90% refund or the option to retain tickets for a postponement date. In purchasing a Ticket, Attendees agree that 10% of the total purchase value of the Ticket will be retained by Baseline Festival as part of the expenses that the Event has or will incur in organising the Event.

    • If Limitless Touring is able to successfully secure government insurance, support or similar, all ticket holders will receive a 100% refund.

  • All Tickets are in the form of QR codes and will be scanned upon entry. Once a QR code has been scanned and swapped for a Wristband the QR code cannot be used again. The first scanned Ticket to arrive at the Event will be allowed entry; any subsequent Ticket with the same QR code will be denied access.

  • Baseline Festival accepts no responsibility or liability for any inconvenience caused by the unauthorised duplication of a Ticket. The QR code in the tickets is not to be shared or duplicated in any way.

  • Baseline Festival is unable to verify or guarantee that Tickets purchased from unofficial third-party resellers are valid or genuine. Invalid or duplicated QR codes will not be valid or allow entry.

  • The name on the Ticket must be the name on the Ticket Holder’s identification. Baseline Festival reserves the right to disable the Ticket editing feature provided by the Ticket seller.

  • Wristbands and other forms of Accreditation that are removed, tampered with, and lost will not be replaced. Those without valid Wristbands or those who are unable to show Wristbands when required will be removed from the site. All Wristbands issued by Baseline Festival remain the property of the Event and are required for identification until the Event is finished.

  • Any attempts by attendees to manipulate or interfere with their Wristbands will be construed as an attempt to contravene these conditions of entry and may result in denial of entry and immediate removal from the site.

  • Attendance is at the Ticket holder’s own risk. Baseline Festival and Limitless Touring Limited will not be held liable for any loss, injuries or damages sustained at the Event including damage, theft or loss of property and motor vehicles, if the cause is due to the Ticket Holder’s negligence or the unforeseeable actions of third parties including other Attendees, Contractors or other third parties.

  • The Event Organisers promote safe behaviour and take all endeavours to provide a safe environment. The Event includes safe spaces and Festival Staff are available to assist and support Attendees when required. The Event Organisers have no tolerance for any form of antisocial and harmful behaviour and any Attendee found to be posing a risk to others will be removed from the site.

3. CONDITIONS OF ENTRY

  • The Event Organisers will not permit the entry of Attendees who break the following conditions of entry and will remove from the site those who break these rules at their discretion without warning.

  • No refunds will be provided to Attendees who breach these conditions of entry.

  • The conditions of entry intend to ensure a safe environment for all Attendees and will be strictly enforced.

  • The Event Organisers and Limitless Touring Limited reserve the right to refuse admittance to patrons whom

  1. Are deemed to be intoxicated and / or disorderly.

  2. Refuse to have a bag/ person search conducted.

  3. Are carrying items which are deemed to have the potential to cause injury or public nuisance.

  4. Hold a ticket purchased through an unauthorised seller.

  5. Cannot produce valid R18 ID (Passport, NZ Drivers Licence, HAANZ R18 card, Kiwi Access Card)

  • The following non-exhaustive list of behaviour is at all times strictly prohibited at the Event:

  1. Anti-social or threatening behaviour to other Festival attendees or staff or behaviour in violation of the conditions of entry which intend to ensure the safety of Attendees;

  2. Impersonating a member of staff or security;

  3. Any attempt to enter restricted areas;

  4. Attempts and actions that start any form of fire, bonfire or naked flame;

  5. Bringing animals into the Event and thereby risking the safety of animals;

  6. Using illegal drugs or substances at the Event;

  7. All forms of sexual harassment whether verbal or physical;

  8. Any discriminatory act including homophobia, racism, transphobia, sexism or any other activity causing harm or posing risks to others.

  9. Participating in dangerous activities such as aggressive dancing, stage diving, crowd surfing or climbing structures;

  10. Attempts to damage property of other attendees, Baseline Festival or property on site; and

  11. Any other antisocial or harmful behaviour creating risk to others.

  • Attendees must allow authorised staff including any member of New Zealand Police to search their vehicles, clothes, bags, containers, or other possessions for items in violation of Baseline Festival’s conditions of entry.

  • Pass outs are not available for this event.

  • Alcohol will not be permitted to leave the event site.

  • Personal items brought into the event will be at the owners own risk and management will not be held responsible for the loss or damage to any personal property.

  • Unauthorised soliciting and customer survey is not permitted.

  • Items deemed to be in violation of these Conditions of entry will be confiscated and not returned. The following non-exhaustive list of items are at all times strictly prohibited from entering or being at the Event:

  1. Alcohol in any form;

  2. Illegal drugs or substances;

  3. Camp chairs;

  4. Any item considered to be a weapon or able to be used as a weapon including knives, sharp objects, etc;

  5. Glass in any form, excluding small packaging including, for example, make-up or perfume;

  6. Stoves, grills, generators, or gas canisters;

  7. Flammable material or material used to construct fires or live flames

  8. Gang patches or gang affiliated clothing;

  9. Laser devices, aerial drones, unofficial drones and unmanned aerial vehicles;

  10. Spray cans and marker pens;

  11. Unofficial hi-visibility clothing, unofficial credentials;

  12. Signs or materials displaying discriminatory, derogatory or offensive messages or slogans;

  13. Any other dangerous items posing risk to persons or property.

  • The following list of items are allowed entrance to the Event:

  1. Empty reusable water-bottles;

  2. A reasonable quantity of snacks / food;

  3. Small bags;

  4. Jerseys, blankets and other clothing;

  5. Vapes & Cigarettes;

  6. Prescription medication (You must provide evidence of your prescription at the gate)

  • The Event Organisers reserve the right to confiscate any potentially harmful items or substances at our discretion. This includes work tools, ladders, two-way radios that can be deemed potential security breaches. Baseline Festival reserves the right to confiscate such items on entry to the car parks or Festival gates.

  • E-cigarettes are allowed but e-cigarette liquid is only allowed if it is sealed and easily identifiable. If e-cigarette liquid is not identifiable or the seal is broken, it will be confiscated.

  • Ticket Holders are responsible for removing any items that can present a safety or security risk prior to arrival.

4. AGE POLICY

  • The Event is strictly restricted to ages 18 and over. Ticket Holders under the age of 18 years old will be refused entry at the gate, even with a valid Ticket. Refunds will not be provided for underage Ticket Holders.

  • All Ticket Holders must produce valid identification at the entry gate and at any time if requested by security, bar staff, or management throughout the Festival.

  • If an Attendee does not provide identification that is valid and up to date, the Attendee will be refused entry into the Festival site and if required, removed from the site.

  • Valid photographic identification is limited to original versions of NZ driving license, HANZ Kiwi Access Card, or international passports. Photocopies or digital copies on phones will not be accepted.

  • Refunds for purchased Tickets will not be provided to Ticket Holders who are unable to enter the Festival site due to being underage or being unable to provide a valid form of identification.

5. MEDIA POLICY

  • Filming and photography are permitted throughout the public areas of the Festival site for personal use. Any filming or photography must be carried out respectfully and respect the privacy of Attendees.

  • Filming and photography for commercial purposes must only be undertaken with the prior written approval provided by Limitless Touring Limited.

  • Any Attendees filming or taking photographs are expected to be courteous to other Festival Attendees and ask for permission before taking any up-close shots.

  • If an Attendee is found to be filming or photographing to make a profit or for commercial purposes onsite without permission, any equipment being used may be confiscated and the Attendee may be removed from the Festival.

  • Photographs taken by Attendees at the Event cannot be included in any sponsored programme or in any form of advertising without approval by Limitless Touring Limited.

  • Photography is restricted or prohibited in certain areas such as welfare and medical areas, security and police stations, all backstage areas and tents and camping areas where there is a reasonable expectation of privacy. The privacy of attendees must be respected at all times.

  • By attending the Festival site, Attendees agree to grant the Festival Organisers permission to use photographs and film material taken at the Festival in any publicity, marketing, or promotional materials.

  • Attendees will be filmed, photographed, and recorded for television, feature films, radio, webcast, and other public broadcasts and by security cameras and recordings for safety and security purposes. The event organisers will endeavour to make signage available upon entrance to the Festival to ensure that Attendees are aware that they may be filmed and photographed during the Festival.

  • Baseline Festival will not use any photographs or material recorded or filmed at the Festival in a way which breaches a person’s privacy or causes harm. For more information, refer to the Baseline Festival Privacy Policy.

8. INTELLECTUAL PROPERTY

  • The names ‘Baseline Festival’ and ‘Baseline’ are registered trademarks and may only be used with explicit written consent provided by Limitless Touring Limited.

  • Pictures and content contained on our websites are the property of Baseline Festival and may not be duplicated or used without written and explicit consent provided by Limitless Touring Limited.
